REAL ESTATE AUCTION DISCLAIMER, TERMS & CONDITIONS
It is the responsibility of each bidder to familiarize themselves with all auction terms and conditions prior to bidding. All sales conducted at auction are final, absolute, and irrevocable. The terms of the auction are not subject to change or renegotiation after the auction concludes.
Bidders are strongly encouraged to carefully review all printed auction materials and to listen to any announcements made by the Auctioneer on the day of sale, as such announcements may include property specifications, updates, term modifications, and/or disclosures, which shall become part of the auction terms.
The Buyer is responsible for obtaining any professional advice deemed necessary prior to bidding, including but not limited to legal, financial, environmental, or inspection services. By registering to bid, each bidder acknowledges receipt of and agrees to be bound by the Auction Terms and Conditions and the Sale Contract, unconditionally and irrevocably.
TERMS AND CONDITIONS OF SALE

AS-IS SALE
The Property is being sold “AS IS, WHERE IS,” with no repairs, updates, or modifications to be made by the Seller. Neither the Seller, Auctioneer, Agent, nor Broker makes any warranties or representations, express or implied, regarding the condition of the Property. -
NO WARRANTIES
No warranties or representations are made as to the condition or functionality of any systems or components of the Property, including but not limited to:-
HVAC systems

Water wells
-
Septic or sewer systems
-
Structural integrity
-
Plumbing or electrical systems

EARNEST MONEY DEPOSIT
A non-refundable earnest money deposit equal to ten percent (10%) of the final hammer price is required on the day of sale, immediately following the auction. -
CLOSING
The transaction shall close within forty-five (45) days or less from the auction date. -
NO CONTINGENCIES
This sale is not contingent upon financing, inspections, appraisals, or any other buyer contingencies of any kind.
AUCTION PROCEDURES
The Auctioneer reserves the right to establish, modify, and control bidding increments at all times during the auction.
The auction may be recorded by B&B Auction Co., LLC. All recordings are the exclusive intellectual property of B&B Auction Co., LLC and are protected by copyright law. No portion of the auction may be recorded, reproduced, or used in any form by anyone other than the Auction Company without prior written consent. All attendees acknowledge and agree that their image and voice may be recorded.
BUYER ACKNOWLEDGMENTS AND RELEASE
In making the decision to purchase the Property, Buyer acknowledges that they are relying solely and completely on their own judgment and on the judgment of any contractors, inspectors, or advisors selected by Buyer.
Buyer agrees that the Purchase Price reflects consideration of all known and unknown defects, including but not limited to physical and environmental conditions. Buyer purchases the Property in its present condition, without warranties or representations of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, habitability, or value, except as expressly set forth in the Sale Contract.
Buyer acknowledges that neither the Seller nor any agent or representative involved in this transaction is an expert in detecting or repairing physical or environmental defects.
Buyer hereby releases and forever discharges Seller, Auctioneer, Broker, and Agents from any and all claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees and court costs), whether known or unknown, contingent or otherwise, arising from or related to the physical or environmental condition of the Property.
The provisions of this section shall survive closing and delivery of the deed.
